How is a shopping malls fault that a guest falls into a water fountain while that guest is texting and not paying any attention to what is going on around her?
We have seen stories like this far too many times. Someone does something without using any common sense and sues someone else because of it. Its just one more case of someone trying to get rich off of their own dumb behavior or mistake. The mall did not force her to text and walk at the same time. She did that all on her own. She was the one that paid no attention to her surroundings. It was entirely her mistake and no one should have to pay for it but her.
Same can be said for anyone who does something dumb or isnt paying attention or both.
