Anna Nicole Smith?s longtime companion and lawyer, Howard K. Stern, has challenged the tragic model's ex-boyfriend over claims he's her daughter's biological father, insisting his dates don't add up. Filing an appeal in the Bahamas-based DNA battle for paternity of baby Dannielynn, Stern claims his love rival, Larry Birkhead, can't be the father. In his affidavit, the lawyer reveals Birkhead and Smith's romance ended "well before the preceding 280th day (pregnancy period) from the birth of Dannielynn Howard Marshall Stern." Stern, who is named as the baby's father on her birth certificate, also insists that, despite claims to the contrary, his late girlfriend never "resided" with Birkhead at his California home. Kitt, I was listening to MSNBC this morning and they had Krista Bartha, Howard's attorney was on. can this attorney answer a question when she is asked why Howard refuses to take the DNA? nope, she goes tangent about the subject. when asked who is taking care of the baby right now she stated Howard's sister and his parent's plus Mrs. Gibson and another nanny who had been with Anna before she died. poor child!

I was listening to MSNBC this morning and they had Krista Bartha, Howard's attorney was on. .................................................... Is she the little blonde "sassy one" I have been seeing on TV. If it is, she's got a mighty big attitude! I saw her a while back and she stated she was very confident that her client Howard K. Stern was the owner of the mansion in the Bahamas and they would prove it! lol!! Guess she felt short in that one. No, she's not very good about answering the questions given to her!

Why isn't STern taking care of that kid instead of everyone else? He is such a moron and his lawyers are too. This whole thing is ridiculous. There is no stability what so ever in this kids life-she does not know one day to the next who the heck is going to be watching over her. These judges better see the light already and get this paternity thing over and the kid out from Stern.

Well what Sterns lawyer want and what they get hopefully will be two different things. Larry and others get to plea for the results of this tomorrow as well and hopefully the judge will release them and tell Howie boy to shut up

Ok one thing i want to say as abrit....if there laws over there r supposed to be the same as ours ive never ever heard of having to prove that you was in a relationship x amount of days b4 birth...we just do dna and thats it ( when thats done even)

I do admit i dont get that one at all. Tbh i dont get where they get these ideas they can appeal on these things. I do think..regarding the inquest i can see where hes appealing there cos ppl can say what they want...and he can end up getting charged with murder cos of it.

Here's how ridiculous speculation and the media can be: From TMZ: Howard K. Stern lost a big one in the Bahamas today. Stern's appeal on DNA testing was just rejected, and Howard K. was penalized by the three-judge panel to the tune of $10,000. TMZ has learned Stern was ordered to pay $5,000 in attorney's fees to the Registrar General and $5,000 to Birkhead's lawyer -- not Debra Opri, the Bahamian one. ========================================= From ET: BREAKING NEWS: ET has learned that Howard K. Stern's paternity appeal has been dropped. Just in today, ET has learned that attorneys for HOWARD K. And another from CNN: The court said Stern had filed his challenge too late and should have raised his objections before the Supreme Court ordered DNA testing in the paternity challenge filed by Larry Birkhead, a former Smith boyfriend who claims to be the father of the infant, Dannielynn. Justice Emmanuel E. Osadebay noted that Stern himself had agreed to DNA testing and waited until a week after the sample was taken to file the challenge.
